    AN ACT = concerning=20 Latino families.
 
    Be it = enacted=20 by the People of the State of Illinois,
represented in the General=20 Assembly: =
 
    Section = 1.=20 Short title. This Act may be cited as = the=20
Illinois Latino Family Commission=20 Act.
 
    Section = 5.=20 Legislative Findings. It is the policy = of this=20
State to promote family preservation and to = strengthen=20
families.
    Latinos = are well=20 represented among the families of
Illinois. The Illinois Latino population is = the fifth=20 largest
in the nation. Over 14% of the estimated = 12,000,000=20 people that
live in Illinois are Latinos. According to the = 2000=20 Census
figures, more than 1,750,000 Latinos make = Illinois=20 their home.
This figure represents a 69.2% increase from = the 1990=20 Census
figures compared to about 3.5% for = non-Latinos. The=20 Latino
population explosion accounted for two-thirds = of the=20 total
population change in Illinois and it is = visible=20 throughout the
State.
    In Cook = County=20 alone, the Latino population has increased
to about 1,071,740. In the 6 county region = including=20 Cook
County, nearly 69% of new residents were = Hispanic.=20 Roughly
23.7% of Kane County residents are Latino. In = Lake=20 County,
Latinos make up 14.4% of the total county=20 population.
    Latinos = are not=20 only the fastest growing ethnic group in
the State, they are also the youngest. The = median age=20 for
Latinos in Illinois is 25, compared to 36 for=20 non-Latinos.
Despite unprecedented population growth, = Latinos lag=20 behind in
major indicators of well-being relative to = education,=20 health,
employment, and child welfare, as well as=20 representation
throughout the State. Moreover, Latino = children and=20 families
present unique linguistic, cultural, and = immigration=20 issues
for the State.
    Latinos = have a=20 well-established presence in the child
welfare system. Of the total 86,973 children = that were=20 reported
abused or neglected in Fiscal Year 2001, about = 8,442=20 or 9.7%
were Hispanic children. About 25% of these = hotline=20 reports were
indicated, for a total of 2,155 Latino = children in=20 Fiscal Year
2001. As of August 2003, there were about = 1,367 open=20 Latino
child abuse cases in Illinois. This figure is = only=20 slightly
lower than the 1,491 open Latino child cases = reported=20 for the
previous fiscal year. Hispanic cases make up = about 6%=20 of all
open child cases (excluding adoption = assistance and=20 home of
parent living arrangement). Latino families = receiving=20 services
make up about 16% of all intact family cases. = It is=20 estimated
that between 60% and 80% of all Latino = families=20 involved with
the Illinois Department of Child and Family = Services=20 (IDCFS)
will need bilingual services at some point = during the=20 time
their case is open. However, IDCFS struggles = to meet=20 the demand
for bilingual services. There are similar = examples=20 throughout
the State demonstrating that Illinois lacks a = unified=20 and
comprehensive strategy for addressing the = unique needs=20 of
Latino families.
    Latino = families=20 remain outside of the margins of
opportunities in the State. There are = tremendous=20 challenges
faced by Latino families and children in the = State.=20 Clearly,
the growing Latino presence demands that = government,=20 child and
family advocates, and other key stakeholders = come=20 together to
identify and implement policy strategies that = can=20 create an
infrastructure of support for Latino families = in the=20 State.
Building this needed infrastructure of = policies must=20 involve
multiple State agencies. The Illinois Latino = Family=20 Commission
shall lead the effort, advising the Governor = and=20 assisting
State agencies with this = task.
 
    Section = 10.=20 Established. The Illinois Latino Family=20
Commission is established. =
 
    Section = 15.=20 Purpose and objectives.
    (a) The = purpose=20 of the Illinois Latino Family Commission is
to advise the Governor and General Assembly, = as well=20 as work
directly with State agencies to improve and = expand=20 existing
policies, services, programs, and = opportunities for=20 Latino
families. Subject to appropriation, the = Illinois=20 Latino Family
Commission shall guide the efforts of and = collaborate=20 with
State agencies, including: the Department on = Aging,=20 the
       =  (1)=20 monitoring and commenting on existing and proposed =        =  (2)=20 assisting State agencies in developing programs,        =  (3)=20 facilitating the participation and representation =        =  (4)=20 promoting research efforts to document the impact =
Department of Children and Family Services, = the=20 Department of
Commerce and Economic Opportunity, the = Department of=20
Corrections, the Department of Human Services, = the=20 Department
of Public Aid, the Department of Public = Health, the=20 Department
of Transportation, the Department of = Employment=20 Security, and
others. This shall be achieved primarily by:=20
    legislation and = programs=20 designed to address the needs of
    Latinos in Illinois;=20
    services, public = policies, and=20 research strategies that
    will expand and = enhance the=20 social and economic well-being
    of Latino children and = families;
    of Latinos in the = development,=20 implementation, and
    planning of policies,=20 programs, and services; and
    of policies and = programs on=20 Latino families.
    The work = of the=20 Illinois Latino Family Commission shall
include the use of existing reports, research, = and=20 planning
efforts, procedures, and=20 programs.
 
    Section = 20.=20 Appointment; terms. The Illinois Latino = Family=20
Commission shall be comprised of 15 members. = The=20 Governor, the
President of the Senate, the Minority Leader = of the=20 Senate, the
Speaker of the House of Representatives, and = the=20 Minority
Leader of the House of Representatives shall = each=20 appoint 3
members to the Commission. Each member shall = have=20 working
knowledge of human services, community = development,=20 and
economic public policies in Illinois. The = Governor=20 shall
appoint the chairperson or = chairpersons.
    The = members shall=20 reflect regional representation to
ensure that the needs of Latino families and = children=20
throughout the State are met. The members = shall be=20 selected
from a variety of disciplines. They shall = represent a=20
partnership and collaborative effort between = public=20 and
private agencies, the business sector, and=20 community-based
human services organizations.
    Members = shall=20 serve 3-year terms, except in the case of
initial appointments. Five members, as = determined by=20 lot, shall
be appointed to one-year terms; 5 members = shall be=20 appointed to
2-year terms; and 5 members shall be appointed = to=20 3-year terms,
so that the terms are staggered. Members shall = serve=20 without
compensation, but shall be reimbursed for=20 Commission-related
expenses.
    The = Department on=20 Aging, the Department of Children and
Family Services, the Department of Commerce = and=20 Economic
Opportunity, the Department of Corrections, = the=20 Department of
Employment Security, the Department of Human = Services,=20 the
Department of Public Aid, the Department of = Public=20 Health, and
the Department of Transportation shall each = appoint a=20 liaison
to serve ex-officio on the Commission. The = Office of=20 the
Governor, in cooperation with the State = agencies=20 appointing
liaisons to the Commission under this = paragraph, shall=20 provide
administrative support to the=20 Commission.
 
    Section = 25.=20 Funding. The Illinois Latino Family = Commission=20
may receive funding through specific = appropriations=20 available
for its purposes made to the Department on = Aging, the=20
Department of Children and Family Services, = the=20 Department of
Commerce and Economic Opportunity, the = Department of=20
Corrections, the Department of Human Services, = the=20 Department
of Public Aid, the Department of Public = Health, and=20 the
Department of Transportation. The funding = allocation=20 for the
Commission shall be no less than=20 $500,000.
 
    Section = 30.=20 Reporting. The Illinois Latino Family=20
Commission shall annually report to the = Governor and=20 the
General Assembly on the Commission's progress = towards=20 its goals
and objectives.

    Section = 99.=20 Effective date. This Act takes effect = upon=20
